A man suspected of exposing himself in front of a Chula Vista elementary school was ordered Tuesday to stand trial as well as for a felony in resisting arrest.
Two Chula Vista police officers testified in the preliminary hearing of
Justine Jeffery Sison, 24, is charged in the Oct. 9, 2014, incident in front of the McMillin Elementary School on Santa Cora Avenue.
Sison was also ordered to trial on charges of engaging in lewd conduct in public and possession of marijuana by Chula Vista Superior Court Judge Edward Allard III. The judge set a trial date for March 11.
No students witnessed the indecent exposure which occurred around 8:45 a.m., but a mother did and told police what happened. Several parents called 911.
The officers told the judge what the mother said she saw without requiring her to testify.
Officers found Sison in a nearby restaurant’s bathroom where he allegedly resisted arrest by an executive officer.
Police said witnesses stated Sison matched the description of the man who exposed himself.
Most of the charges are misdemeanors except for the felony conduct while resisting arrest. The school principal sent out an email notifying parents of the arrest and reminded parents and students of safety rules.
Sison’s father testified as a defense witness during the two and a half-hour hearing. Sison pleaded not guilty to all charges at the conclusion and the judge set future court dates. He remains in the South Bay Detention Facility on $20,000 bail.
