Man sentenced for Carlsbad rape

A Chula Vista man was sentenced May 3 to 15 years in state prison for raping a 22-year-old male acquaintance in a Carlsbad motel at gunpoint.

Antoine Demond Henderson, 45, was given the term by Vista Superior Court Judge Sim von Malinowski, who gave him credit for 1 1/2 years in jail since his arrest on Oct. 21, 2016. The victim did not attend the sentencing.

Henderson pleaded guilty to assault with a deadly weapon and rape with a foreign object. Charges of kidnapping for oral copulation, false imprisonment, and carrying a concealed handgun were dismissed.

Henderson unsuccessfully tried for months to withdraw his guilty plea but von Malinowski denied his request on May 3 and proceeded with sentencing. He received a stipulated term of 15 years that was agreed to with Deputy District Attorney Kate Flaherty and his original attorney.

The incident took place on Oct. 20, 2016 in Escondido. The young man was taken to a motel in Carlsbad. The charges say Henderson threatened him with a handgun and a knife.
The young man was able to call 911. Henderson fled, but the young man gave a description of his car, which was stopped by a Carlsbad police sergeant.
