An attorney for the city of Chula Vista on Wednesday filed court papers to request a gentlemen’s club on the city’s bayfront be shut own.
Deborah Fox filed a request for abatement of a public nuisance against Eyecandy on June 26 asking the Superior Court to take action.
“The city is informed and believes and based thereon alleges that unless restrained by the order of this court, the defendants will continue to operate the adult cabaret as a public nuisance in violation of Chula Vista Municipal Code Chapter 9.13,” the request reads.
Eyecandy Showgirls attorney Roger Diamond said it remains a mystery if Eyecandy will close, move or continue to operate.
“I don’t know what Eyecandy’s plans are,” Diamond said.
Diamond also said he is aware of a complaint regarding the operation of Eyecandy but he said is not aware of an abatement.
Among a list of complaints, the city contends the strip club violates the city’s zoning code.
“Any day that the business remains open as an adult establishment it violates the zoning code,” Fox said. “It can operate at its location, just not as an adult establishment.”
Diamond said Eyecandy is not in violation of a zoning code or any city code.
In May, the city of Chula Vista’s Developmental Services Department compiled a list of over 200 addresses in which Eyecandy can move to and be in accordance with the zoning code.
Earlier this year, the city ordered the club to cease operating as a nude-dancing establishment and to fix numerous building code violations by June 6.
