Accused could get 75 years

A trial date will be set on May 3 for Maurice Flournoy, 41, who was ordered to stand trial on charges of raping a National City woman at 5 a.m. after breaking into her apartment on Oct. 15, 2011.

Flournoy, of La Mesa, is accused of rape, forcible oral copulation and felony assault during a burglary. The victim testified April 19 in the preliminary hearing before Chula Vista Superior Court Judge Esteban Hernandez.

The victim testified the rape occurred while her son and daughter were asleep in another room. She testified she thought the attacker had a knife, as he threatened to stab her if she screamed. After the attacker left, she called National City Police right away.

Officers saw a man fitting the suspect’s description on 26th Street in National City around 6 a.m. and detained him. The victim identified him in a curbside lineup and he was arrested.

Deputy District Attorney Allen Brown said Flournoy faces 75 years to life for the one strike rape law if he’s convicted. Flournoy did not know the victim.

Flournoy was also ordered to stand trial for drunk driving in a separate, unrelated case that occurred about a month before the rape. There were no injuries or crash from that incident, but he is also charged with driving with a suspended license.

Flournoy was free on $15,000 bond when he allegedly committed the sexual assault, according to court records.
He has pleaded not guilty to all charges in both cases and remains in jail on $2.7 million bail.
