A judge on Wednesday scheduled a June 30 preliminary hearing for Alejandro Gutierrez, who is accused of attempted murder in a gang related shooting in Chula Vista on April 2.
Gutierrez, 38, fled the area following the shooting and was not arrested until April 20. He is charged with attempted murder, assault with a deadly weapon, and felon in possession of a firearm.
Gutierrez was convicted of attempted murder in 1996, according to Chula Vista Superior Court records. The current charges allege he tried to kill a man with a semi-automatic pistol as part of Gutierrez’s association with a criminal street gang.
He evaded capture twice in April in a storm drain, but members of the U.S. Marshals Fugitive Task Force found him at a motel in San Ysidro on April 20.
Gutierrez’s attorney sought a delay in the preliminary hearing Wednesday when he appeared before a Chula Vista Superior Court judge. Gutierrez has pleaded not guilty and remains in the George Bailey Detention Facility without bail.
